Any payments transacted through the portal will be billed in New Zealand dollars.
This website uses a professional 3rd party payment gateway provider to perform all online payment transactions. No credit information or CVV2 codes are stored on this website.
All fees are payable directly to the Council/Building Consent Authority the application is submitted to.
Section 6 - Optional Tools
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Section 7 - User Comments, Feedback and Other Submissions
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain unlawful, abusive or obscene material, or to your knowledge (having taken reasonable care) contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. All Councils/Building Consent Authorities operating as a building consent authority are responsible for the approval and issuing of consents. Applying through the portal does not in any way guarantee the approval or otherwise of any application.

If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable permitted by applicable law.
Section 12 - Termination
These Terms of Service are effective unless and until terminated by either you or us, the parties agree to use their best endeavours to resolve any dispute or differences that may arise under the terms of service. The following process will apply to disputes:
- a party must notify the other if it considers a matter is in dispute.
- a Simpli representative will attempt to resolve the dispute through direct negotiation
- if negotiation does not resolve the dispute the parties agree to mediation in good faith.
Section 13 – Waiver and Ambiguities
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
Section 14 - Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New Zealand.
